01Introduction

These Terms and Conditions govern your use of the website at mycraftkindred.com (the "Website") and any purchase you make from Craft Kindred Inc. ("we," "us," or "our"). They apply in full and affect your use of the Website.

By browsing the Website or placing an order, you agree to be bound by these terms. If you do not agree with any part of them, please do not use the Website or order from us. We also handle personal information as described in our Privacy Policy, which forms part of these terms.

02Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet that requirement and that the payment method you use is your own or that you have permission to use it.

Certain areas of the Website may be restricted, and we may further restrict access at our discretion. If you hold any credentials for the Website, you are responsible for keeping them confidential.

03Intellectual property rights

Other than content you own and submit, Craft Kindred Inc. and its licensors own all intellectual property rights in the Website and its materials, including text, photography, product imagery, graphics, logos and layout.

You are granted a limited licence to view this material for your own personal, non-commercial use. That licence does not permit copying, republication or commercial exploitation of any of it.

04Acceptable use

• use the Website in any way that damages it or impairs anyone else's access to it;

• use the Website to carry out your own advertising or marketing;
• attempt to gain unauthorised access to any part of the Website, our systems, or another user's account;
• place orders you do not intend to pay for, or use the Website to commit fraud.

05Products, descriptions and availability

Our goods are handmade. Photographs and descriptions are intended to represent each piece accurately, but colour, grain, texture, finish and dimensions vary from one piece to the next, and screens render colour differently. Reasonable variation of this kind is a characteristic of the work rather than a defect.

All items are subject to availability and are made in limited batches. We may change, limit or discontinue any product at any time, and we may limit quantities per customer or per order.

06Pricing and errors

Prices are shown in the currency indicated at checkout and may change at any time before you order. Any applicable taxes, duties or import charges are your responsibility unless we state otherwise at checkout.

We take care with pricing and product information, but errors occur. If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed at that price, whether or not the order has been confirmed and whether or not payment has been taken. If we cancel on that basis, we will refund you in full.

07Orders and payment

Your order is an offer to buy. A confirmation email acknowledges that we've received it; the contract forms when we accept the order and dispatch it. We may decline or cancel an order — including after confirmation — where a product is unavailable, where payment cannot be authorised, where we suspect fraud, or where an error of the kind described above has occurred.

Payment is taken at the time of order. By submitting payment details you confirm you are authorised to use the payment method and that the details you have given are complete and accurate. Payments are processed by third-party providers under their own terms and security standards.

08Shipping and delivery

In-stock items are typically dispatched within 2–3 business days. Shipping is free and insured, and tracking is emailed to you when your parcel moves. Delivery estimates are estimates, not guarantees; carriers, customs and weather can all delay a parcel beyond our control.

Risk of loss passes to you on delivery. If a parcel is lost or arrives damaged, contact us — see Returns, refunds and cancellations — and we'll put it right. You are responsible for providing a complete and accurate delivery address; we cannot be held responsible for parcels sent to an address entered incorrectly at checkout.

09Returns, refunds and cancellations

You may return an item within 30 days of delivery. Email support@craftkindred.com with your order number and we will send return instructions and the correct address. Do not ship an item back before receiving those instructions.

Items should be returned in the condition they arrived in. You are responsible for return shipping costs, and original shipping and handling charges are non-refundable. Once your return has arrived and been inspected, we will confirm by email and refund the original payment method, less shipping and handling.

If an item arrives damaged, faulty, or not as ordered, please contact us within 30 days of delivery and provide photographs and we will replace the item or issue a full refund for the purchase price. Customers are responsible for all shipping costs associated with returning the item.

10Your content

"Your Content" means any text, images, audio, video, review or other material you submit to the Website. By submitting it, you grant Craft Kindred Inc. a non-exclusive, worldwide, irrevocable, sub-licensable licence to use, reproduce, adapt, publish, translate and distribute it in any media.

Your Content must be your own and must not infringe anyone else's rights. We may remove any of Your Content at any time, without notice, at our discretion.

11No warranties

The Website is provided "as is" and "as available," with all faults, and Craft Kindred Inc. makes no representations or warranties of any kind relating to the Website or the materials on it, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Nothing on the Website constitutes advice.

12Limitation of liability

To the fullest extent permitted by law, Craft Kindred Inc., together with its officers, directors and employees, shall not be liable for anything arising out of or in any way connected with your use of the Website, whether such liability arises in contract, tort or otherwise, and shall not be liable for any indirect, consequential or special loss.

Where liability cannot lawfully be excluded, our total liability in connection with any order is limited to the amount you paid for that order. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law.

13Indemnification

You indemnify Craft Kindred Inc. to the fullest extent against all liabilities, costs, demands, causes of action, damages and expenses arising in any way from your breach of any provision of these terms.

14General provisions

Severability

If any provision of these terms is found to be invalid under applicable law, that provision will be removed without affecting the remaining provisions.

Variation of terms

We may revise these terms at any time. The version published on this page at the time you place an order is the version that governs that order, so please review this page from time to time.

Assignment

We may assign, transfer or subcontract our rights and obligations under these terms without notice. You may not assign, transfer or subcontract any of yours.

Entire agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Craft Kindred Inc. in relation to your use of the Website, and supersede all prior agreements and understandings.

15Governing law and jurisdiction

These terms are governed by and interpreted in accordance with the laws of the State of California, and you submit to the non-exclusive jurisdiction of the state and federal courts located in California for the resolution of any dispute. If you are a consumer resident elsewhere, you may also have the benefit of mandatory provisions of the law of your own country.
